Transitioning to the new program

The time-of-transaction building energy use disclosure program (AB 1103) will remain in effect until December 31, 2015. To submit comments regarding the AB 1103 program, please click "Rulemakings" then "Submit e-Comment."

There will be no statewide energy use disclosure requirement in 2016. During this time, Energy Commission staff will conduct a rulemaking - a public process to develop regulations and establish the infrastructure for the new statewide benchmarking program mandated by Assembly Bill 802. Staff anticipates that regulations for the new program will become effective in 2017. To submit comments on the new program, visit and click "Submit e-Comment on 15-OIR-05."

Implementation postponed for buildings 5,000-10,000 square feet

On September 2, 2014, the Office of Administrative Law (OAL) approved the California Energy Commission's proposal to delay implementation of the Nonresidential Building Energy Use Disclosure Program for buildings from 5,000 to 10,000 square feet until July 1, 2016.


The Nonresidential Building Energy Use Disclosure Program encourages greater energy efficiency in nonresidential buildings by requiring building owners to disclose energy use to prospective buyers, lessees, and lenders, as well as to the California Energy Commission. This statewide program applies in addition to benchmarking and disclosure programs already in place and under development in local jurisdictions.

  • The regulations explain which building types are included, when compliance is required, and obligations for utility providers and building owners.

  • The regulations apply to most nonresidential buildings larger than 10,000 square feet, and disclosure is required by a specific date (specified in the regulations) prior to the close of a transaction.
