Notice of a Commission Adoption Hearing,
Availability of 2nd 15-Day Language for Review,
and Opportunity for Comment



INTRODUCTION

The California Energy Commission (Energy Commission) will hold a hearing to adopt proposed amendments to the Appliance Efficiency Regulations contained in the California Code of Regulations (CCR), Title 20, Sections 1602, 1604, 1606, and 1607. The purpose of this rulemaking as discussed in the Notice of Proposed Action is to adopt amendments to the Appliance Efficiency Regulations consistent with federal and state law and with a Federal Court Order, and Joint Status Conference Statement Order.1

At the hearing any person may present written or oral comments on the proposed amendments.

WRITTEN COMMENTS

Written comments related to this hearing must be submitted by 5:00 p.m. on June 19, 2007. The start date of the comment period is June 4, 2007 and the end date is June 20, 2007, which is the adoption date for the proposed amendments. Please include the docket number 07-AAER-1 "Appliance Efficiency Regulations 2nd 15-Day Language" in the subject line or first paragraph of your comments. Any interested person may submit written comments on the proposed amendments and additional documents relied upon. Written comments shall be e-mailed to Docket@energy.state.ca.us or mailed or delivered to the following address (e-mailing is preferred):

History

On December 1, 2006 the Energy Commission published a Notice of Proposed Action (NOPA) concerning the potential adoption of proposed amendments to the Appliance Efficiency Regulations (45-Day Language). The NOPA and the 45-Day Language were posted on the Energy Commission website on December 1, 2006. The first public hearing listed on the NOPA, with the Energy Commission's Efficiency Committee (Chairman Jackalyne Pfannenstiel, Presiding Member) was held on December 20, 2006 where public comments were received. At the second public hearing listed on the NOPA, with the full Energy Commission on January 17, 2007, the Energy Commission solicited additional public comments. At this public hearing, the Energy Commission Staff recommended and the Energy Commission agreed to postpone the adoption of the proposed amendments (45-Day Language). The Energy Commission directed the Staff to prepare additional amendments through 15-Day Language for future adoption.

On March 19, 2007 a draft of proposed 15-Day Language was posted on the Energy Commission webpage. After consideration of public comments received, the draft 15-Day language was revised and finalized. A Public Notice was issued providing for review of the 15-Day Language during a public comment period from April 23, 2007 through May 8, 2007, and proposed adoption date on May 9, 2007.

At the May 9, 2007 public hearing the Energy Commission solicited additional public comments. After considering comments received during this 15-Day Public Comment Period, staff recommend and the Commission agreed that adoption be delayed and directed the staff to address these comments in a 2nd 15-Day Language to be published and provided in another 15-Day Public Comment Period.
