On September 27, 2006, Governor Schwarzenegger signed into law Assembly Bill 32, "The California Global Warming Solutions Act of 2006." This legislation requires the California Air Resources Board (ARB) to adopt a greenhouse gas (GHG) emissions cap on all major sources, including the electricity and natural gas sectors, to reduce statewide emissions of greenhouse gases to 1990 levels by 2020. The legislation also requires the ARB to consult with all state agencies with jurisdiction over sources of greenhouse gases, including the California Energy Commission (Energy Commission) and the California Public Utilities Commission (Public Utilities Commission), on all elements of its plan that pertain to energy related matters.
The Energy Commission and Public Utilities Commission Joint AB 32 Implementation Committee has issued for public comment its proposed Interim Decision which contains recommendations on policy principles regarding point of regulation and allocation. If adopted by both Commissions, the recommendations will be submitted to the ARB for its consideration as part of the AB 32 Scoping Plan.
Issuance of the Interim Opinion and Expected Consideration
The proposed Interim Opinion on Greenhouse Gas Regulatory Strategies was issued on February 8, 2008. The Energy Commission will take public comment and consider adopting the Interim Opinion at a regular Business Meeting scheduled for March 12, 2008. The Public Utilities Commission will take public comment and consider adoption on March 13, 2008, (for further information regarding the Public Utilities Commission process, please consult the Public Utilities Commission either by telephone at (415) 703-2782, or by e-mail at http://www.cpuc.ca.gov/puc/.

To support the ability of the Energy Commission and the Public Utilities Commission to develop joint recommendations to ARB, we ask that parties submit their comments and reply comments, both in the Energy Commission's docket 07-OIIP-01 and to the Public Utilities Commission's R.06-04-009.

Procedures for submitting the filings to the Public Utilities Commission are included here for the parties' convenience. All parties filing comments or replies shall file them at the Public Utilities Commission's Docket Office and shall serve them consistent with Rules 1.9 and 1.10 of the Public Utilities Commission Rules of Practice and Procedure and Resolution ALJ-188. The parties shall serve their comments and replies on the service list for R.06-04-009 posted at www.cpuc.ca.gov when the filings are made, and shall mail a hard copy of the filings to the assigned Commissioner and assigned Administrative Law Judges.
