TO THE RENEWABLES PORTFOLIO STANDARD ELIGIBILITY GUIDEBOOK

As part of the August 11, 2004 Business Meeting, the Energy Commission will consider adopting revisions to the Renewables Portfolio Standard Eligibility Guidebook (Guidebook). This Guidebook was previously updated at the May 19, 2004 Business Meeting. The proposed changes apply to the certification requirements for Municipal Solid Waste Conversion Facilities.
The Energy Commission's Renewables Committee (Committee) appreciates and has carefully considered the oral and written comments received in response to the May 19, 2004 Business Meeting. At this time, however, the Committee recommends that the Energy Commission's guidelines regarding RPS implementation should not be modified in response to those comments. The proposed changes address questions raised in the process of certifying Municipal Solid Waste Conversion Facilities.
The Committee recommends modifying the Renewables Portfolio Standard Eligibility Guidebook to revise the eligibility criteria for Municipal Solid Waste Conversion Facilities. The May 19th Renewables Portfolio Standard Eligibility Guidebook requires parties applying for certification as an RPS eligible waste conversion facility to attain a Conversion Technology Facility Permit from the California Integrated Waste Management Board (CIWMB). The proposed changes recognize that some projects may be entitled to an exemption from the Conversion Technology Facility Permit requirements, but otherwise are eligible for the RPS. In such cases, applicants seeking certification as an RPS eligible project must submit supporting documentation from a local enforcement agency and/or the CIWMB in lieu of a permit.
The Committee recommends these proposed changes be adopted pursuant to Public Resources Code section 25747, which authorizes the Energy Commission to approve substantive changes to the Guidebooks upon providing 10 days public notice. Changes take effect once approved at a publicly-noticed meeting.

The Energy Commission encourages members of the public to submit written comments on the proposed revisions to the Guidebooks in advance of the Business Meeting. An original and 21 copies of any comments filed by mail or in person should be provided to the Energy Commission's Docket Unit. Parties may also file a single copy electronically with the Docket Unit and follow up with an original copy by mail. The Committee encourages comments to be submitted by e-mail so that comments may be posted on the RPS proceeding webpage.
