Notice of Availability of the
Renewables Portfolio Standard Procurement Verification Report


The California Energy Commission adopted the Renewables Portfolio Standard 2005 Procurement Verification Report (Verification Report) at its August 1, 2007 Business Meeting. The final adopted report is now publicly available.

The California Renewables Portfolio Standard (RPS) requires the state's retail sellers of electricity - investor-owned utilities (IOUs), electric service providers (ESPs), and community choice aggregators (CCAs) - to serve 20 percent of their retail electricity sales with eligible sources of renewable energy by 2010. The statutes also require the Energy Commission to design and implement a tracking system to verify compliance with the RPS program and ensure that renewable energy procured to meet California's RPS is counted only once and is not counted toward meeting other renewable energy retail claims.

The Verification Report was developed in furtherance of the statutory requirements for RPS accounting and verification and provides the Energy Commission's analysis of the renewable energy procurement by the IOUs: Pacific Gas and Electric Company, Southern California Edison Company, and San Diego Gas & Electric. The Verification Report covers the 2004 and 2005 calendar years and includes data from 2001 through 2005, where applicable. While this report estimates the progress of the IOUs in meeting their RPS targets, the California Public Utilities Commission (CPUC) determines their actual compliance.

This RPS Procurement Verification Report transmits the Energy Commission's RPS procurement verification findings to the CPUC. The purpose of the report is to:

  • Verify RPS-eligibility of the renewable energy facilities from which each IOU procured energy.

  • Verify, to the extent possible, the amount of energy procured by each IOU from each RPS-eligible facility.

  • Verify, to the extent possible, that RPS procurement exclusively serves California's RPS and does not support another renewable energy market claim.

  • Verify that renewable facilities located out-of-state satisfy the Energy Commission's RPS energy delivery requirements.

  • Apply statutory requirements and the CPUC's rules to identify incremental procurement and annual procurement.

  • Quantify the amount of incremental geothermal energy.

  • Compare the CPUC's annual procurement targets for each IOU with the Energy Commission's findings for how much procurement qualifies toward the targets.

Pursuant to Decision 06-10-050 and a March 12, 2007 Ruling (R.06-05-027), the CPUC adopted a schedule for filing and serving updated RPS compliance reports to the CPUC. The ruling requires that updated compliance reports will be due to the CPUC within 30 days after the Energy Commission issues its Verification Report. For the purpose of initiating the 30-day clock, the CPUC recently clarified that the March 12, 2007 Ruling may be understood to mean that the date that the Energy Commission publishes a "notice of availability" for the Verification Report in Docket #03-RPS-1078 is the date the report is issued by the Energy Commission. Thus, this notice of availability initiates the 30-day clock for the IOUs to submit updated compliance reports to the CPUC.
