The Commission Report on Tracking System Operational Determination (Commission Report) and Appendices are now available. The Commission Report responds to a legislative directive that requires the California Public Utilities Commission and the California Energy Commission (“Commissions”) to conclude that the renewable energy generation tracking system established under Public Utilities Code Section 399.13 subdivision (c) is operational, capable of independently verifying the electricity generated by an eligible renewable energy resource and delivered to the retail seller, and can ensure that renewable energy credits are not double counted by any seller of electricity within the service territory of the Western Electricity Coordinating Council (WECC). These three statutory conditions must be satisfied before the California Public Utilities Commission may authorize the use of tradable renewable energy credits for purposes of the California Renewables Portfolio Standard (RPS).
Senate Bill 1078 (Sher, Chapter 516, Statutes of 2002) established the RPS and directed the Energy Commission to “design and implement a tracking system to ensure that renewable energy output is counted only once for the purpose of the RPS and for verifying retail product claims in California or other states.” The Energy Commission, together with the Western Governors’ Association (WGA) and the WECC, developed the Western Renewable Energy Generation Information System (WREGIS) to meet this legilative mandate and address California’s RPS tracking needs.
The Commissions have developed the criteria and methodology for evaluating the three statutory conditions that WREGIS must satisfy to evaluate the tracking system. These criteria and methodologies were explained in the Draft Joint Commission Staff Report (Draft Report) and presented at an Energy Commission Workshop on March 17, 2008, after which parties submitted comments. The Commissions modified the Draft Report appropriately, and then finalized conclusions based on the analysis of whether WREGIS had satisfied each condition. This modified Draft Report was released in a California Public Utilities Commission draft Resolution on September 23, 2008, and additional comments were received. The Final Report was adopted at a California Public Utilities Commission meeting on November 21, 2008, and at the Energy Commission Business Meeting on December 3, 2008.
The analyses and conclusions in this Commission Report demonstrate that WREGIS has satisfied the three statutory requirements of Public Utilities Code Section 399.13 subdivision (c). The Commission Report is not intended to serve as the authorization of the use of tradable renewable energy credits for RPS compliance. The California Public Utilities Commission will address that subject in a separate decision.
