The California Energy Commission Siting Committee will conduct a workshop to discuss staff's proposed revisions to the regulations governing the Rules of Practice and Procedure and Power Plant Site Certification Information Requirements.

Purpose

The Energy Commission staff is proposing revisions to the regulations governing the Rules of Practice and Procedure and Power Plant Site Certification. An initial workshop was held September 20, 2006, to hear comments from interested parties. The comments received may be viewed on the Commission's website at http://www.energy.ca.gov/siting/rulemaking/documents/index.html. The staff's proposed changes to the regulations, based on the comments received, will be available on the website by November 3, 2006. This second workshop will focus on the oral and written comments received and suggested changes to the staff's proposed revisions. Following the workshop, the Siting Committee will propose amended revisions for consideration and possible adoption by the Energy Commission.

Background

On October 6, 2004, the Energy Commission issued an Order Instituting Rulemaking (Order) for the proposed adoption, amendment to, and repeal of regulations governing the Rules of Practice and Procedure and Power Plant Site Certification Regulations. Energy Commission staff has recommended a number of revisions to the regulations identified in the Order. The Energy Commission delegated its authority for this rulemaking proceeding to the Siting Committee composed of two Commissioners. The Committee is empowered to take all actions necessary to comply with all applicable legal requirements of the Public Resources Code, the Administrative Procedure Act (Govt. Code 11340 et seq.), and implementing regulations, including submitting, after a Commission hearing, all necessary documents to the Office of Administrative Law, and issuing notices for all hearings and workshops.

Written Comments

Written comments on the proposed revisions were due on October 16, 2006. The Siting Committee may elect to accept additional comments at a future date following this workshop.
