The Energy Commission's Siting Committee is proposing revisions to the regulations governing the Rules of Practice and Procedure and Power Plant Site Certification. On February 13, 2007, the Commission filed a Notice of Proposed Change (NOPC). The notice may be viewed at http://www.energy.ca.gov/siting/rulemaking/notices. The Energy Commission had originally scheduled a final public hearing for February 14, 2007; given the NOPC, it has rescheduled the final hearing as an agenda item at its regular Business Meeting on February 28, 2007, at 10:00 a.m. This hearing will focus on the staff's proposed revisions, comments received, suggested changes to the proposed revisions and possible adoption of the regulations.


On October 6, 2004, the Energy Commission issued an Order Instituting Rulemaking (Order) for the proposed adoption, amendment to, and repeal of regulations governing the Rules of Practice and Procedure and Power Plant Site Certification Regulations. Energy Commission staff has recommended a number of revisions to the regulations identified in the Order (04-SIT-2). The Energy Commission delegated its authority for this rulemaking proceeding to the Siting Committee composed of two Commissioners. The Committee is empowered to take all actions necessary to comply with all applicable legal requirements of the Public Resources Code and the Administrative Procedure Act (Govt. Code § 11340 et seq.). Its authorization extends to implementing regulations including submitting, after a Commission hearing, all necessary documents to the Office of Administrative Law, and issuing notices for all hearings and workshops.

Written Comments

If you have any comments regarding the proposed changes outlined in the NOPC, the Energy Commission is accepting written comments until February 27, 2007. All written comments must be submitted to the Commission no later than 5:00 p.m. on February 27, 2007, and addressed to:
