for the Blythe Energy Project ) SCHEDULING ORDER
(Blythe Energy, LLC) )
______________________________)

I. BACKGROUND

This Scheduling Order is based on discussions at the May 4, 2000, Informational Hearing and the proposed schedules submitted by Staff in its May 2, 2000, Issues Identification Report and by Applicant in its May 1, 2000, Proposed Schedule.

The following Committee Schedule lists the events that must occur in order to meet the 12-month review period. This schedule only covers the period through the release of the Final Staff Assessment (FSA) and the filing of testimony by all parties and, thus, differs from Staff’s proposed schedule. The balance of the schedule will be determined following the Prehearing Conference. To satisfy the statutory directive that the Commission issue a decision within 12 months from the date an application is deemed complete, the Committee intends to present a recommendation on the license to the full Commission by March 21, 2001. (See Pub. Resources Code, sections 25522 (a), 25540.6 (a).)

Several deadlines are contingent upon reviews to be conducted by federal, state, and local agencies. The Committee recognizes that delays in the completion of those reviews may necessitate schedule modifications.

The Committee may modify the schedule at any time either upon its own motion or that of any party. (Cal. Code of Regs., tit. 20, section 1709 (c).) The schedule requires periodic status reports from the parties to determine whether case development is progressing satisfactorily and to bring potential schedule delays or other relevant matters to the Committee's attention. If the Applicant cannot provide necessary information by the dates set forth in the schedule, the Committee will consider adopting a performance approach that would result in a day-for-day slip in the balance of the schedule.
