NOTICE OF
COMMITTEE WORKSHOP ON
COMMENTS ON PRESIDING
MEMBER'S PROPOSED DECISION

Background:

The Committee assigned to the above-captioned matter released its Presiding Member's Proposed Decision (PMPD) on the Blythe Energy Project, Phase II on October 21, 2005, thereby beginning a 30-day public comment period on the PMPD. On November 21, 2005, the Center on Race, Poverty & the Environment files comments. On November 23, the U.S. Environmental Protection Agency filed comments.

Upon review of these comments, the Committee is considering changes to the PMPD and seeks the further comments of the parties, agencies, and public thereon. The possible changes to the PMPD are:

  1. With supporting discussion, change Condition AQ-C9 to require the use of the EPA's updated emission factors in determining the amount of paving required to offset project PM10 emissions;

  2. With supporting discussion, change Condition AQ-18 to acknowledge that the federal EPA must approve interpollutant trade-offs in accordance with the Mojave Desert Air Quality Management District Rule 1305(B)(6)(a).

  3. With supporting discussion, change Condition AQ-C10 to clarify the Applicant's showing that an ammonia slip exceedance of 5 ppm is a false trigger.

  4. Any other matter arising from the discussion at the Workshop
