I. COMMISSION ORDER

At the CommissionÕs Business Meeting on February 3, 1999, the Commission determined that the Application for Certification (AFC) for the Delta Energy Center (Applicant) in the above-captioned matter is not complete and, therefore, shall not be deemed accepted at this time. (See, Title 20, Cal. Code of Regulation, Section 1709.) The portions of the AFC that fail to meet the information requirements under Section 1704 (Title 20, Cal. Code of Regulations, Section 1704.) of the CommissionÕs regulations include the items noted in the Executive DirectorÕs January 15, 1999, Data Adequacy Recommendation; these items are incorporated herein by reference. Although the applicant has submitted supplemental materials to cure these information deficiencies, the data was not submitted in a timely manner to allow for Commission review or public comment.

II. NOTICE OF COMMISSION HEARING

The applicantÕs supplemental materials will be reviewed over the next two weeks and the Commission will conduct a public hearing on the matter of data adequacy at its next Business Meeting as follows:
