The Committee will conduct formal hearings on the following dates to receive evidence on the topics indicated in Attachment A. This NOTICE provides information regarding the dates and locations of the hearings to be held October 13, November 3, and November 10, 1999. This Notice also includes a schedule of witnesses for each topic, the dates for filing prepared testimony and exhibits [Attachment A-1]; the dates for filing briefs, and a summary of the schedule [Attachment B-2]. II. BACKGROUND On September 9, 1999, Committee issued a Notice of Evidentiary Hearings and Procedures setting forth the schedule for hearings, and the sequence for taking evidence on all the relevant topics of concern. Pursuant to that Notice, the Committee conducted hearings on October 5th. The hearing tentatively scheduled for October 6th as a continuation of the October 5th hearing was cancelled since it was not necessary.
Due to concern that the topics of air quality and public health may require extensive hearing time, the Committee has rescheduled the hearings on socioeconomics (including issues regarding environmental justice), air quality, and public health to Wednesday, November 10, 1999, at 5 p.m.
III. FILING REQUIREMENTS
During evidentiary hearings, the parties (Applicant, Staff, and Intervenors) will present evidence consisting of sworn testimony and exhibits on each topic area. Please take notice that the parties are directed to submit copies of their proposed exhibits and exhibit lists along with their prepared testimony.
The date for filing testimony on biological resources, and soil and water resources is October 20, 1999. Rebuttal testimony is due October 28, 1999. The date for filing supplemental testimony on socioeconomics, and testimony on air quality and public health is October 28, 1999, with rebuttal testimony due November 8, 1999.
- October 10, 1999 - Rebuttal testimony on land use due.
- October 20, 1999 - Testimony and copies of exhibits on biological resources, and soil and water resources due.
- October 28, 1999 - Testimony and copies of exhibits on socioeconomics, air quality and public health due.
- October 28, 1999 - Rebuttal testimony on biological resources, and soil and water resources due.
- November 8, 1999 - Rebuttal testimony on socioeconomics, air quality, and public health due.
The Committee has also established a briefing schedule as follows:
- Briefs on the topics heard October 5, 1999, are due October 18, 1999
- Briefs on the topics heard October 13, 1999, are due October 25, 1999
- Briefs on the topics heard on November 3, 1999, and November 10, 1999, are due November 17th
All filings shall be served upon all parties and the Energy Commission's Docket Unit, 1516 Ninth Street, MS 4, Sacramento, California 95814-5512. Each party is responsible for ensuring that its respective submittals are received no later than 5 p.m. on the dates indicated. Identify all filings with "Docket No. 98-AFC-3."
IV. PUBLIC PARTICIPATION Members of the public and interested governmental agencies are invited to attend these hearings and may offer unsworn public comment upon the matters discussed at the hearings. These public comments will be entered into the record of the proceeding and may be used to supplement or explain the evidence of record. Public comments by themselves, however, are not sufficient to support a finding of fact or a decision on an issue.
