I. NOTICE OF SECOND REVISED SCHEDULE PLEASE TAKE NOTICE THAT the schedule for evidentiary hearings in this proceeding has been REVISED. The previously scheduled hearing on November 10, 1999 has been cancelled. The new hearing date is Thursday, November 18, 1999. The hearing previously scheduled on November 3, 1999 will occur as scheduled.
The Committee will conduct formal hearings on the following dates to receive evidence on the topics indicated in Attachment A-2. This NOTICE provides information regarding the dates and locations of the hearings to be held November 3 and November 18, 1999. This Notice also includes a schedule of witnesses for each topic, the dates for filing prepared testimony and exhibits; the dates for filing briefs, and a summary of the revised schedule as shown in Attachment B-2.

II. BACKGROUND
The Bay Area Air Quality Management District released its Final Determination of Compliance (FDOC) on October 25, 1999. To allow the parties time to review the FDOC and to prepare their testimony, the Committee has rescheduled the hearing on the topics of socioeconomics (including issues related to environmental justice), air quality, and public health.

III. FILING REQUIREMENTS
During evidentiary hearings, the parties (Applicant, staff, and Intervenors) will present evidence consisting of sworn testimony and exhibits on each topic area. Please take notice that the parties are directed to submit copies of their proposed exhibits and exhibit lists along with their prepared testimony.
The due date for filing staff's and Applicant's testimony on socioeconomics (environmental justice), air quality and public health is November 8. Intervenors' testimony is due on November 12. Rebuttal testimony is due November 15.
- October 28 - Rebuttal testimony on biological resources, and soil and water resources due.
- November 8 - Staff and Applicant's testimony on socioeconomics, air quality, and public health due.
- November 12 - Intervenors' testimony on socioeconomics, air quality, and public health due.
- November 15 - Rebuttal testimony on socioeconomics, air quality and public health due.
The Committee has also established a briefing schedule as follows:
- Briefs on the topics heard on November 3rd are due November 11th
- Briefs on the topics heard on November 18th are due November 24th
All filings shall be served upon all parties and the Energy Commission's Docket Unit, 1516 Ninth Street, MS 4, Sacramento, California 95814-5512. Each party is responsible for ensuring that its respective submittals are received no later than 5:00 PM on the dates indicated. Identify all filings with "Docket No. 98-AFC-3."
IV. PUBLIC PARTICIPATION Members of the public and interested governmental agencies are invited to attend these hearings and may offer unsworn public comment upon the matters discussed at the hearings. These public comments will be entered into the record of the proceeding and may be used to supplement or explain the evidence of record. Public comments by themselves, however, are not sufficient to support a finding of fact or a decision on an issue.
