NOTICE OF RECEIPT

PETITION TO AMEND THE ENERGY COMMISSION DECISION FOR THE
ELK HILLS POWER PROJECT (99-AFC-1C)

On December 11, 2002, the California Energy Commission (Energy Commission) received a petition from Elk Hills Power, LLC, to amend the Energy Commission Decision for the Elk Hills Power Project (EHPP). EHPP is a nominal 500 MW natural gas-fired, combined-cycle power plant located within the Elk Hills Oil and Gas field, approximately 25 miles west of Bakersfield between the communities of Buttonwillow and Taft in Kern County. The power plant is currently under construction, and is scheduled for commercial operation in April 2003.

DESCRIPTION OF PROPOSED CHANGES

(1)    Modification of air quality Condition of Certification AQ-21, and the addition of one new air quality condition, to allow for "tendering" of particulate matter (PM10) emission reduction credits (ERCs) for the natural gas-fired combustion turbines to allow for flexibility based upon the outcome of the initial source tests. No increase in PM10 limits is requested; however, if PM10 limits are reduced, then there will be a corresponding reduction in the ERCs that will be required to be surrendered by Elk Hills Power to the San Joaquin Valley Air Pollution Control District, and

(2)    The addition of a new air quality condition of certification to allow for a temporary increase in emission limits for nitrous oxides (NOx), carbon monoxide (CO) and volatile organic compounds (VOC) during the commissioning phase.

ENERGY COMMISSION REVIEW PROCEDURES

The purpose of the Energy Commission's review process is to assess the impacts of this proposal on environmental quality, public health and safety. The review process includes an evaluation of the consistency of the proposed changes with the Energy Commission's decision and if the project, as changed, will remain in compliance with applicable laws, ordinances, regulations, and standards (Title 20, California Code of Regulations, Section 1769). Energy Commission staff is currently reviewing the request and will publish an analysis in the next few weeks. A public hearing for the purpose of approving or denying the amendment proposal will subsequently be held at a regularly scheduled Energy Commission business meeting.

This Notice of Receipt is being mailed to interested parties and property owners adjacent to the project site who may want to participate in the amendment process.
