On January 6, 1999, the California Energy Commission held a public hearing, as part of its regularly scheduled business meeting, to consider the Proposed Decision issued by the Energy Facility Siting Committee in the above-captioned matter. The Committee recommended that, pursuant to Public Resources Code section 25540.6(a)(1), the Commission exempt the prospective Elk Hills Power Project from the Notice of Intention requirements of Public Resources Code section 25502.

After considering this recommendation and comments received at the January 6, 1999 hearing, the Commission hereby adopts the CommitteeÕs December 14, 1998 Proposed Decision, as its Decision in this matter.
