I. BACKGROUND
On January 7, 2000, the Committee for the above-captioned proceeding issued an Order Denying a Petition to Intervene (COMMITTEE ORDER) filed by Transmission Agency of Northern California (TANC). On January 21, 2000, Petitioner TANC appealed the Committee Order to the full Commission pursuant to Title 20, California Code of Regulations, section 1207(d).
The Commission considered the matter at the regularly scheduled February 9, 2000, Business Meeting. Dennis W. DeCuir appeared as Counsel for TANC; Jane E. Luckhardt appeared for the Applicant, Elk Hills Power, LLC; Kerry Willis, Counsel, and engineer Mark Hesters, represented Staff.
Having duly considered the record before it, the presentation of Counsel for the parties, and Staff, the Commission rules as follows:
II. ORDER OF THE COMMISSION
- For the reasons set forth in the COMMITTEE ORDER on TANC's Petition to Intervene;
- Good and reasonable cause appearing;
- TANC having been granted an opportunity by the foregoing COMMITTEE ORDER to participate in the proceedings "to the extent that it would entail briefing of issues and submittal of comment on decisions pertinent to the issues TANC raises," and therefore
- TANC's appeal is hereby DENIED.
