The purposes of the Project Status Hearing are to review:

1. the status of the proceeding,


2. the timeliness of Applicant data submissions, and


3. the schedule for the remainder of the Application for Certification (AFC) proceeding.

On October 18, 2001, Energy Commission staff filed its Status Report No. 1 that reviewed the developments since the filing of its Initial Staff Assessment on June 15, 2001. Staff's Status Report also enumerates current issues and informational needs. Staff lists eleven items that in its view need to be delivered by the Applicant in order to allow a complete, independent assessment of the potential for impacts from the project. Staff states that it can prepare and file its Final Staff Assessment 30 days after the receipt of such information.

On October 31, 2001, Applicant, El Segundo Power filed Applicant's Comments in Response to Staff's Status Report stating generally that there are only four informational items which have now been filed. The Applicant replies to Staff's list of outstanding information that such information is not due, but rather is an issue of potential dispute between the Applicant, Staff, and perhaps other parties. Thus, Applicant suggests that, after Staff produces its Final Staff Assessment on the basis of the information delivered, the proceeding should progress to Evidentiary Hearings to adjudicate issues in dispute.

Any party may file and serve legal briefs, comments, and/or declarations on or before November 19, 2001, addressing appropriate Committee action. The parties may file detailed proposed schedules for events up to the Committee Workshops/Prehearing Conference.
