Given the continuing exchange of information from Applicant to other agencies, the CEC Staff, and other parties, the Committee believes that one more set of clarifying data requests may be needed. To the extent a staff workshop may expedite the information exchange, the Committee is providing for staff Data Response Workshops.
The Applicant's represents that the Preliminary Determination of Compliance (PDOC) currently available is the likely document the South Coast Air Quality Management District (SCAQMD) will "notice" in the near future for public and agency review. This PDOC contains and limits options for PM10 offsets, namely, enhanced street sweeping or Priority Reserve. Based upon this information the Committee believes that Staff should proceed with its analysis for the Final Staff Assessment on the basis of this PDOC.
However, to assure consistency between the PDOC and the Staff Assessment, the SCAQMD must have "noticed" the PDOC for comment before Staff may release its Assessment. Staff shall have 10 days after the PDOC is "noticed" to review it for consistency with the information used to prepare the Air Quality section of the Assessment. The release of the Final Assessment and the remainder of the schedule will be tolled until the "noticed" PDOC is issued by SCAQMD.
Pursuant to Public Resources Code section 25523(b), the Energy Commission's Decision shall include provisions to meet the objectives of the Coastal Act (PRC § 30000 et seq.) as submitted in a Report prepared by the Coastal Commission, unless the Energy Commission finds the Report's provisions to result in a greater adverse effect on the environment or would not be feasible.
The Committee believes that the Energy Commission staff should proceed with Assessment using the Coastal Commission staff comments, in anticipation that the Coastal Commission will act on the Report before the Prehearing Conference. The adopted Report needs to be available before the Prehearing Conference so that any party may decide prior to the Prehearing Conference whether there is an issue related to a provision of the Report which it will contest. Therefore, the conduct of the Prehearing Conference and remainder of the schedule will be tolled until the Coastal Commission Report is adopted.
