The California Energy Commission El Segundo Committee (Committee) is reviewing an Application for Certification (AFC) by the EL Segundo Power II LLC to replace existing El Segundo Generating Station (ESGS) Units 1 and 2 in the City of El Segundo with a 630-megawatt, natural gas-fired, combined cycle electric generation facility.

The purpose of the evidentiary hearings is to establish the factual record upon which this case will be decided through the taking of oral, written, or documentary evidence from the official parties to the proceeding on the topics listed in the side bar.

The public and interested agencies are encouraged to attend and make comments on the topics to be discussed listed in the side bar. For consideration in the Committee's Proposed Decision, written comments on the topics can be submitted to the Energy Commission, Docket Unit (00-AFC-14), 1516 - 9th Street, Sacramento, CA 95814 before February 20, 2003.

Whether made at the evidentiary hearing or submitted in writing, public comments will be entered into the record of the proceeding and may be used to supplement or explain the evidence in the record. Public comments by themselves, however, are not sufficient to support a finding of fact or a decision on an issue.

The Commission's Public Adviser is available to provide information or to assist those interested in participating at the evidentiary hearing, but cannot act as the attorney for any party. Deadline for Filing and Service of Prepared Written Testimony:
January 22, 2003; Written Rebuttal Testimony: February 10, 2003

Witnesses may appear by declaration instead of in person if the topic is uncontested. If a topic is contested, a witness must appear in person to testify under oath and may be subject to cross-examination by other parties. A party sponsoring an expert witness, either by declaration or in person, shall establish the witness' qualifications.

Uncontested and contested topics and the order of testimony are shown in Appendix A, attached.

 

In accordance with instructions given at the January 7, 2003, Prehearing Conference, prepared written testimony shall be filed and served on or before January 22, 2003. Prepared written rebuttal testimony shall be filed and served on or before February 10, 2003.

* For clarity of the record and administrative convenience, the Committee shall designate parties to either of two sides of the Biology Aquatic issues. On February 18 and 19, each side shall have a total of 5 hours to present its direct testimony and rebuttal testimony, which shall have been filed in pre-prepared written form, as well as to cross-examine witness(es) from the other side. Each side shall apportion in its discretion between its direct testimony, rebuttal testimony, and its cross-examination of the other side's witness(es). For clarity of the record and administrative convenience, the Committee may establish a panel of a side's or party's witnesses for either or both direct testimony, rebuttal testimony, or cross-examination.
