The California Energy Commission El Segundo Committee
(Committee) is reviewing an Application for Certification
(AFC) by the El Segundo Power II LLC to replace
existing El Segundo Generating Station (ESGS) Units
1 and 2 in the City of El Segundo with a 630-megawatt,
natural gas-fired, combined cycle electric generation
facility.
On August 23, 2004, the Applicant submitted a proposal
regarding the topic of Aquatic Biology. The purpose
of the workshop is to receive comments from parties
regarding this new proposal, including its suggested
revision to Condition of Certification BIO-4.
The Committee notes that the Applicant's proposed
BIO-4 addresses a study, to be completed in conjunction
with the Los Angeles Regional Water Quality Control
Board (LARWQCB), to fulfill the Phase II 316(b)
regulations. The Committee wishes that, as a result
of this workshop, it will have received sufficient
information from LARWQCB, regarding the development
of that study, so that the Committee can fully evaluate
the Applicant's proposal. Therefore, the Committee
requests that LARWQCB provide an informational briefing
as to its plans to initiate the upcoming 316(b)
Study for an NPDES operating permit which will be
required for El Segundo's existing cooling water
intake structure.
To provide a framework for the workshop, the Committee
asks that the Applicant, Staff, agencies, intervenors,
and the public address the following:
- Applicant's Proposal, dated August 23, 2004,
for additional enhancements to BIO-4 regarding
both the specifics and the proposed schedules
therein.
- Staff's proposed "fully mitigated option"
for aquatic biology as outlined in its April 27,
2004, filing.
- The sufficiency of a LARWQCB-directed 316(b)
study to address potential project impacts.
- The development and oversight of the design
of the 316(b) study.
- The necessity and timing of a project-related
316(b) study.

The Committee intends to advance this proceeding,
as expeditiously as possible, in order to bring
a proposed decision to the full Commission for consideration.
This workshop will be important to this process.
Therefore, the Commission will accept comments on
the various proposals submitted by the parties in
the area of Aquatic Biology.
The Committee requests that each agency with aquatic
biology-related interests attend the workshop with
a representative who has sufficient authority to
negotiate and reach agreements on behalf of his/her
agency regarding potential stipulations of fact
or proposed Conditions of Certification.
Further, the Committee anticipates that each agency
shall file comments prior to the workshop
so that oral statements made by the agencies during
the workshop will only summarize those comments,
thus creating more time for question/answer sessions
of the workshop participants.
