NOTICE OF RECEIPT
PG&E PETITION TO CLARIFY IT IS THE SOLE OWNER OF THE
Gateway POWER PLANT UNIT 8 AND CHANGE THE NAME OF THE PROJECT TO THE
GATEWAY GENERATING STATION (00-AFC-1C)

On December 4, 2006, Pacific Gas and Electric Company (PG&E) filed a petition with the California Energy Commission requesting to change the ownership and the name of the Gateway Power Plant Unit 8 Project. The 530-megawatt project was certified by the Energy Commission on May 30, 2001. Construction of the facility started late in 2001 and was suspended in February of 2002 due to financial considerations. The Gateway Power Plant Unit 8 Project was suspended with approximately seven percent of construction completed. On July 19, 2006, the Energy Commission approved the addition of PG&E as co-owner of the project with Mirant Delta, LLC. The facility is located north of the City of Antioch, in Gateway County.

DESCRIPTION OF PROPOSED MODIFICATION

The changes proposed in the petition would clarify that PG&E is now the sole owner of Gateway Power Plant Unit 8, removing Mirant Delta, LLC as a co-owner, and would change the name of the project to the Gateway Generating Station.

ENERGY COMMISSION REVIEW PROCEDURES

A statement describing the change in ownership, signed under penalty of perjury by a representative of the proposed sole owner of the project, was submitted to the Energy Commission staff for review and approval as required by Title 20, California Code of Regulations, section 1769(b). As part of the January 13, 2006 petition to add PG&E as a co-owner of the project (approved by the Energy Commission on July 19, 2006), PG&E filed a statement affirming that it agrees to be bound by the requirements of the Energy Commission's Decision for the project and understands the obligations imposed by the Conditions of Certification. Based on the information provided, staff intends to recommend the proposed change be approved by the Energy Commission at the January 3, 2007 business meeting.

The petition is available on the Energy Commission's website at www.energy.ca.gov/sitingcases/gateway/compliance/index.html The Energy Commission Order (if approved), will also be posted on the website.
