ORDER DIRECTING STAFF TO LIST

PAST CONDITIONS OF CERTIFICATION

SOUTHERN COMPANY'S Gateway POWER PLANT PROJECT,
APPLICATION FOR CERTIFICATION, DOCKET NO. 00-AFC-1












Purpose of Order:

The Gateway Power Project AFC Committee proposes to use several new processes and formats to make our regulatory review and its documentation more efficient and easier to comprehend. The Committee will become involved earlier in the year-long process in the review of potential project impacts, possible mitigation or alternatives, and potential conditions of certification. The Committee will also stress the use of non-adjudicatory processes.

To these ends, the Committee needs for itself and the parties to the proceeding a list of conditions of certification from prior Energy Commission proceedings which have by practice become standardized or routine, as well as those which have had application for a facility such as is proposed in this proceeding.

Once Staff produces this list of past conditions, the Committee contemplates that by subsequent order it will direct the Applicant to prepare and file a document (in a format to be prescribed by the Committee) which will identify (1) potential project impacts, and (2) Applicant-accepted, proposed mitigation/conditions associated with the potential impacts. The Committee expects the Applicant to utilize the standardized or routine conditions enumerated in the Staff list, as well as others that are appropriate.

Thereafter, under the auspices of the Committee in informal, non-adjudicatory workshops well in advance of the prehearing conference, the Committee will request the Staff, interested agencies, parties and the public to respond to and comment upon the Applicant's assessment of potential impacts and the adequacy of the Applicant's proposed mitigation/conditions.

For the Committee, the goal is to reach early consensus on matters not subject to contest on a complete description of a potential project impact and a satisfactory condition or alternative to mitigate the associated potential impact, all sufficient for inclusion in the Presiding Member's Proposed Decision.

Order To Staff:

Staff shall prepare from the last 4 - 6 certified projects a document aggregating all conditions of certification (verifications optional) by subject matter. Identical or substantially similar conditions need be presented only once and, if appropriate, characterized as "standard" conditions. All other conditions shall be presented with the related project name. Within each subject matter, Staff may further categorize or sort conditions in order to associate conditions by any common feature(s).

Due Date:

The Staff list of past conditions shall be filed and served on all parties on or before September 1, 2000. The Staff shall provide the Committee with an electronic file of this information.

Status Reports:

All parties shall file and serve monthly, beginning August 1, 2000, status reports concerning information requested or to be provided and any other matter relevant to the maintenance of the proceeding schedule.
