COMMITTEE SCHEDULING ORDER

On July 19, 2006, the Application for Certification (AFC) was deemed data adequate for the twelve-month review process consistent with Public Resources Code section 25540.6. The Committee conducted a public informational hearing on September 19, 2006, to discuss the schedule and other issues of concern. The attached Committee Schedule is based on Staff's proposed schedule and related discussion at the informational hearing.

The Committee Schedule contains a list of events that must occur to complete the certification process. The schedule contains entries for each event but the dates are left to be determined in a future order. This is necessary because one of the key early steps-filing of the air district's Preliminary Determination of Compliance (PDOC)-remains uncertain. During the informational hearing, Mr. Mohsen Nazemi, representing the South Coast Air Quality Management District, was unable to give a definitive timetable for the PDOC. Mr. Nazemi hoped to have a more definitive answer after an air district meeting on September 22. To date, no additional information has been provided to the Committee.

We therefore issue the Committee Schedule in its present form with its deadlines to be determined later. To facilitate that determination, we order the parties to file Status Reports summarizing the status of the PDOC and any other matters potentially affecting the schedule or requiring the Committee's attention, on November 1, 2006, December 13, 2006 and every six weeks thereafter. We expect the exchange of data and preparation of those portions of the Preliminary Staff Assessment which are not dependent on the PDOC to continue during this time.
