COMMITTEE SCHEDULING ORDER

This Scheduling Order is based on the Informational Hearing and Site Visit of January 30, 2002, and the proposed schedules submitted by the Applicant on January 23 and by Commission Staff on January 14 (in its Issues Identification Report).

The following Committee Schedule lists the events that must occur in order to conduct the review process in 12 months. Several deadlines are contingent upon reviews to be conducted by federal, state, and local agencies. The Committee recognizes that delays in the completion of those reviews may necessitate schedule modifications. Although the Commission staff is responsible for meeting Committee deadlines for the filings produced by the Staff, the Applicant bears the ultimate burden of proof in this proceeding. Therefore, the Applicant must be responsible for the timeliness of its own filings as well as those of all other agencies outside the Commission. Thus, a delay by an agency other than the Commission staff in filing a required document may result in a necessary extension to the 12-month schedule.

The Committee may modify its schedule at any time upon either its own motion or that of a party. [Title 20, Cal. Code of Regs., §1709(c).] Here, the Committee Schedule (Schedule) requires periodic status reports from the parties that function:

For the Commission to issue a Final Decision within 12-months from the date the application was deemed complete [See, Pub. Resources Code, §§ 25522 (a); 25540.6 (a).], the Committee has determined that it should conclude evidentiary hearings in this proceeding by September 2002.
