NOTICE OF RECEIPT
PETITION TO CHANGE OWNERSHIP for the
LA PALOMA GENERATING PROJECT (98-AFC-2C)

The California Energy Commission received a petition from the La Paloma Generating Company, LLC, (LPGC) requesting approval to transfer the ownership and obligations imposed by the conditions of certification of the La Paloma Generation Project from the La Paloma Generating Trust to the La Paloma Generating Company, LLC. LPGC also will be the operator of the plant. LPGC has entered into an operations and maintenance agreement with DTE La Paloma Operations, LLC; however, LPGC will retain the ultimate decision-making authority relative to the operations of the plant. The 1,124-megawatt project was certified in October 1999, and began commercial operation in January 2003. The power plant is located east of the town of McKittrick in Kern County.

COMMISSION REVIEW PROCEDURES

A statement describing the ownership change, signed under penalty of perjury by a representative of the proposed new owner of the project, was submitted to the Energy Commission staff for review and approval as required by Title 20, California Code of Regulations, section 1769(b). The statement affirms that the new owner agrees to be bound by the requirements of the Energy Commission's Decision for the La Paloma Generating project. Based on the information provided, staff intends to recommend that the proposed ownership change be approved by the Energy Commission at the November 3, 2004 Business Meeting.

The petition to change ownership is available on the Energy Commission's webpage at www.energy.ca.gov. The order (if approved) will also be posted on the webpage.
