The Los Esteros Critical Energy Facility (LECEF) is a nominal 180-megawatt simple cycle power plant located near the intersection of SR 237 and Zanker Road in the City
of San Jose, Santa Clara County. The project was certified by the California Energy Commission on July 2, 2002.

Calpine C* Power, the project owner, a subsidiary of Calpine Corporation, submitted a petition to Energy Commission staff on September 27, 2002, seeking approval to modify the project description as follows:

DESCRIPTION OF REQUESTED CHANGE: Calpine C* Power is seeking a modification to the description of the project's mechanical feature, as described on page 47-48 of the Energy Commissions Decision. In the section entitled "Engineering Assessment," the Project's facility design discussion describes the facility as including "a two-cell cooling tower for air inlet chillers." Calpine C* Power request that this be changed to read "a two-cell cooling tower for air inlet chillers; single cell to be installed during the initial simple-cycle phase, second cell installed as required for additional equipment loads, such as the construction of the data center, or when the plant is converted to a combined cycle facility." No changes to any Condition of Certification are required as a result of this modification.

Pursuant to section 1769(a)(2), Title 20, California Code of Regulations, Energy Commission approval for the change is not required if Energy Commission staff determines: (1) That there is no possibility that the modification may have a significant effect on the environment, and (2) The modification will not result in a change or deletion of a condition of certification, or make changes that would cause the project not to comply with applicable laws, ordinances, regulations, or standards. Energy Commission staff has determined that the proposed phasing of cooling tower cells meets these criteria because:

  • Existing conditions of certification are sufficient to cover the proposed change without changes to or deletion of a condition of certification;
  • Reducing the number of cooling tower cells will not have any significant effect on the environment because staff determined that a single cooling tower cell would result in a plume frequency and size that would be lower than the original staff assessment; and
  • A reduction in the number of cooling tower cells will remain in compliance with applicable laws, ordinances, regulations or standards.

Any person may file a written objection to staff's determination within 14 days of service of this notice on grounds that the change does not meet the criteria set forth in Section 1769(a)(2).
