On March 26, 2004, the California Energy Commission (Energy Commission) received a petition from Calpine Corporation to change the ownership of the Los Esteros Critical Energy Facility Project. The 180-megawatt project was certified on July 2, 2002 and has been operating since March 7, 2003. The facility is located in Santa Clara County, is San Jose, California.


Calpine Corporation petitions the Energy Commission for a change of ownership approval for its Los Esteros Critical Energy Facility Project. Currently, the owner is listed on the Energy Commission's website as Calpine C* Corporation. The owner of the Project is now Los Esteros Critical Energy Facility, LLC, a wholly-owned subsidiary of Calpine Corporation. There will be no operational changes to the Project.

Pursuant to Title 20, California Code of Regulations, section 1769(b), Los Esteros Critical Energy Facility, LLC continues to be responsible for compliance with the Energy Commission's conditions of certification for the Project. As owner and operator of the Project, Los Esteros Critical Energy Facility, LLC understands the conditions of certification and agrees to comply with them.


The purpose of the Energy Commission's review process is to assess the impacts of this proposal on environmental quality, public health and safety. The review process includes an evaluation of the consistency of the proposed changes with the Energy Commission's Decision and if the project, as changed, will remain in compliance with applicable laws, ordinances, regulations, and standards (Title 20, Calif. Code of Regulations, section 1769). A public hearing for the purpose of approving or denying the amendment proposal will subsequently be held at a regularly scheduled Energy Commission business meeting.

This Notice of Receipt is being mailed to interested parties and property owners adjacent to the project site who may want to participate in the amendment process.
