On March 26, 2004, Calpine Corporation submitted a petition under section 1769(b) of the California Energy Commission regulations for a change in ownership of the Los Esteros Critical Energy Facility Project (01-AFC-12C) from Calpine c* Power, a wholly-owned subsidiary of Calpine Corporation, to Los Esteros Critical Energy Facility, LLC, a wholly-owned subsidiary of Calpine Corporation.
At a regularly scheduled Business Meeting on August 25, 2004, the Energy Commission considered staff's recommendation and approved the Petition in accordance with Title 20, section 1769(a)(3) of the California Code of Regulations.
Based on staff's analysis, the Energy Commission concludes that the proposed change will not result in any significant impact to public health and safety, or the environment. The Energy Commission finds that:
The ownership change will have no effect on the environment.
There will be no changes to, or deletions of, an existing condition or certification.
There will be no operational or system reliability impacts.
There will be no impact on the facility's ability to comply with all applicable laws, ordinances, regulations, and standards, subject to the provisions of Public Resources Code section 25523.
The ownership change has no impact on the public.
The California Energy Commission hereby approves the Los Esteros Critical Energy Facility petition to change ownership.
