On April 14, 1999, the California Energy Commission held a public hearing, as part of its regularly scheduled business meeting, to consider the Proposed Decision issued by the Energy Facility Siting Committee in the above-captioned matter. The Committee recommended that, pursuant to Public Resources Code section 25540.6(a)(1), the Commission exempt the Metcalf Energy Center, as proposed by Calpine Corporation and Enron Enterprises, Inc., from the Notice of Intention requirements of Public Resources Code section 25502.

After considering this recommendation and comments received at the April 14, 1999 hearing, the Commission hereby adopts the CommitteeÕs Proposed Decision dated March 23, 1999, as its Decision in this matter.
