I. BACKGROUND This Order is based on discussions at the July 12, 1999 Informational Hearing and the proposed schedules submitted by Applicant and Staff in their respective July 8, 1999 Issue Identification Reports.
Based upon these materials, we believe it would be unproductive to establish firm dates for the entirety of the proceeding at this time. We therefore establish the scheduling guidance set forth below only through issuance of the Preliminary Staff Assessment (PSA). We will reevaluate scheduling matters at that time, or at such earlier date as may become appropriate.
We have also required the filing of periodic status reports. The parties should use these reports to apprise the Committee of the progress of the case, as well as the emergence of any matters which may delay (or accelerate) issuance of the PSA. Of particular interest at the present time are:
- the development of a Memorandum of Understanding (MOU) with the City of San Jose;
- the necessity of consultations, if any, with the California Department of Fish and Game and/or the United States Fish & Wildlife Service; and
- the expected date for the Preliminary Determination of Compliance (PDOC) by the Bay Area Air Quality Management District (BAAQMD).
Finally, we may schedule additional Conferences, as necessary, to assess the status of this proceeding; any party may also request that we conduct such events. During this phase, Staff shall independently schedule such workshops as are appropriate to develop, discuss, and identify information relevant to the analysis of the proposed project.
