After considering the Petitions filed by Issa Ajlouny, the Committee conducting proceedings in this matter finds as follows:

I. PETITION TO INTERVENE

THEREFORE, the Committee GRANTS the Petition to Intervene in this matter and orders that Petitioner be placed upon the Proof of Service List as an Intervenor. The Petitioner may exercise the rights and shall fulfill the obligations of a party as set forth in section 1712 of the Commission's regulations. (Cal. Code of Regs., title 20, section 1712.)

Further, Staff shall ensure that Petitioner is immediately provided with a copy of the Application for Certification.

II. PETITION FOR FINANCIAL HARDSHIP

On September 25, 2000, Mr. Ajlouny also filed a "Financial Hardship Petition," requesting that he be excused from: 1) filing twelve paper copies of his submittals with the Commission Docket Unit; and 2) serving written copies of his submittals upon other parties of record.

Recent revisions to Commission regulations provide that "[f]ormal filings may be submitted electronically" [Cal. Code of Regs., title 20, section 1209(a)] in specified formats, including "... internet e-mail." [Cal. Code of Regs., title 20, section 1209.5 (a)(3).]

Paper copies of all filings must still be served by first class mail, unless a party agrees to receive filings electronically. [Cal. Code of Regs., title 20, section 1210 (a).] Parties filing documents with the Commission's Docket Unit must provide either twelve paper copies or, alternatively, one original paper copy and electronic copies in specified formats. [Cal. Code of Regs., title 20, section 1209 (c).]

We have previously identified which parties in this proceeding will accept electronic filings. The e-mail addresses for those parties who have so consented are reflected upon the attached Proof of Service list.

These regulatory revisions directly address the substance of Mr. Ajlouny's Petition. Intervenor may serve his filings, via internet e-mail, on the majority of those appearing on the Proof of Service list. Moreover, he now needs to provide the Docket Unit with only a single original paper copy in addition to an electronic copy. In light of these new and substantially less burdensome filing requirements, it appears any "hardship" issues raised in the Petition have been rendered moot.

Thus, Intervenor Ajlouny may serve his future filings by internet e-mail upon those appearing on the Proof of Service list who have e-mail addresses indicated. Intervenor must provide paper copies of all his filings to the other parties, and must provide the Commission Docket Unit with one original paper copy and one electronic copy of all filings.

All filings, whether paper or electronic, must continue to meet filing dates established by the Committee.
