RULING RE MOTION TO DISMISS AND PREPARE AN ADDENDUM OR SUPPLEMENT

I. BACKGROUND

On September 7, 2001, Intervenor Garbett (representing T.H.E. P.U.B.L.I.C.) filed comments on the Revised Presiding Member's Proposed Decision (revised PMPD), including a "Further Motion to Dismiss" (Motion). In this Motion, Intervenor essentially requests we "dismiss" the revised PMPD and direct the preparation of an addendum or supplement to the Application for Certification and/or the Final Staff Assessment. (Motion, pp. 4-5.)

II. RULING

Intervenor's Motion is denied. The Application for Certification and the Final Staff Assessment have been supplemented, updated, and revised to reflect the proposed project and its impacts. All these materials have been subjected to public scrutiny throughout the hearing process. The Committee's evaluation of the project has also been twice available for public review, in the initial PMPD (June 18, 2001) and the revised PMPD (August 24, 2001).
