SECOND NOTICE OF RESCHEDULED HEARING

Please note that the Committee is again forced to RESECHEDULE the Evidentiary Hearing on Duke EnergyŐs habitat enhancement plan, previously scheduled for Thursday, October 24, 2002, the hearing will now take place on:

MONDAY, NOVEMBER 4, 2002
and
TUESDAY, NOVEMBER 5, 2002

Beginning at 9:00 a.m. and continuing as necessary at:

Duke Energy Morro Bay Power Plant
1290 Embarcadero Street
Morro Bay, CA 93442

Submittals must be served upon all parties to this proceeding and one original and eleven (11) copies to the CommissionŐs Docket Unit, MS-4, 1516 Ninth Street, Sacramento, CA 95814, and received no later than 3:00 p.m. on the dates indicated. All materials shall also be served electronically to each party showing an email address on the proof of service list no later than 3:00 p.m. on the dates indicated. Each party is responsible for ensuring that its respective submissions are sent to the docket unit and to each party on the proof of service list in a manner designed to be received no later than 3:00 p.m. on the dates indicated. Identify all documents with "Docket No. 00-AFC-12."

The need to originally reschedule the hearing was due to an unavoidable conflict in the CommitteeŐs schedule and is not related to this case. Subsequent rescheduling is due to the unavailability of witnesses on October 24. The rescheduling necessitates the following revisions to the filing schedule previously issued on September 12, 2002 and reissued on September 27, 2002.

Election Day

Unfortunately, we are required to hold a portion of the hearing on November 5th, Election Day. We anticipate concluding the hearing on November 5th no later than early afternoon. However, for their convenience, participants at the hearing may wish to make arrangements for absentee voting.

Except as identified in this Notice, all other matters regarding the evidentiary hearing will take place according to the Notice and Hearing Order issued on September 12, 2002. Parties to the case and members of the public should refer to the September 12, 2002 Notice for details.
