COMMENT PERIOD FOR THE REVISED
PRESIDING MEMBER'S PROPOSED DECISION
The Committee issued the Revised Presiding Member's Proposed Decision (RPMPD) for the Morro Bay Power Plant Project (Project) on November 21, 2003, with comments due on the RPMPD by December 16, 2003. On November 24, 2003, CAPE requested an extension of the comment period deadline in order to accommodate prior commitments and conflicts in the schedule of CAPE's attorney. Applicant has indicated that it would not object to an extension of the comment period so long as the extension does not effect the date of the Commission's final decision in the case. The Commission will make a final determination in this case after the Central Coast Regional Water Quality Control Board issues a National Pollutant Discharge Elimination System (NPDES) Permit for the Project. Staff for the Regional Board has informed us that an extension of the RPMPD comment period will not affect or delay the date on which the Regional Board considers the NPDES permit for the Morro Bay project.
Accordingly, the Committee hereby grants CAPE's request for an extension of the comment period on the RPMPD. Comments on the RPMPD will be due on January 14, 2004. Twelve copies of all comments must be received no later than 3 p.m. on Wednesday, January 14, 2004, by the Energy Commission's Docket Unit, MS-4, 1516 Ninth Street, Sacramento, CA 95814. Identify all comments with "Docket No. 00-AFC-12."
As stated in a previous notice, the Energy Commission anticipates conducting a future hearing to consider whether the Commission should adopt the RPMPD as its final Decision in this case. Members of the public will be invited to participate and to offer comments at that hearing. A separate notice will be publicized prior to the Commission hearing, tentatively scheduled to take place during the first quarter of 2004.
