NOTICE OF RECEIPT

PETITION TO AMEND THE ENERGY COMMISSION DECISION FOR THE
MOSS LANDING POWER PLANT PROJECT (99-AFC-4C)

On September 5, 2003, the California Energy Commission (Energy Commission) received a petition from Duke Energy North America (Project Owner) to modify the Moss Landing Power Plant Project (Project). The currently operating natural gas-fired, combined-cycle power plant is comprised of two 530 MW combined-cycle units with an overall capacity of 1,060 MW. In addition to the new combined-cycle units, the Project also included the upgrade of existing Units 6 and 7 resulting in an additional 146 MW of capacity. This project is located in the town of Moss Landing, in Monterey County, California.

DESCRIPTION OF PROPOSED MODIFICATION: The proposed modification would change the length of the startup period from four to six hours and the oxides of nitrogen (NOx), carbon monoxide (CO) and volatile organic compounds (VOC) emissions limitations that are applicable during steam turbine cold start-up sequences. The proposed modification would add two new conditions to limit the number of hours per year during which steam turbine cold start-ups and gas turbine combustor tuning may take place, and to add new recordkeeping requirements applicable during these periods. The project will continue to comply with existing daily, quarterly and annual emissions limits. The Project Owner has also submitted a similar request to the Monterey Bay Unified Air Pollution Control District (MBUAPCD) to amend local air quality permit conditions.


ENERGY COMMISSION REVIEW PROCEDURES

The purpose of the Energy Commission's review process is to assess the impacts of this proposal on environmental quality, public health and safety. The review process includes an evaluation of the consistency of the proposed changes with the Energy Commission's decision and if the project, as changed, will remain in compliance with applicable laws, ordinances, regulations, and standards (Title 20, California Code of Regulations, Section 1769). Energy Commission staff is currently analyzing the request and will publish an analysis in the next several weeks. A public hearing for the purpose of approving or denying the amendment proposal will subsequently be held at a regularly scheduled Energy Commission business meeting.

This Notice of Receipt is being mailed to interested parties on the project mailing list to allow them to participate in the amendment process.
