Purposes of Committee Workshops, Prehearing Conference & Evidentiary Hearings:

Based upon the anticipated filings by the Applicant (Siting Review Matrix and LORS Matrix) and the Staff (Verification Timetable) and Energy Commission Staff (Staff Assessment as well as the current status of regulatory review, the Committee believes it to be in the public interest to schedule the remainder of the proceedings as shown below.

As stated in previous orders, after the Applicant has completed, filed and served the Siting Review Matrix and the LORS Matrix, the Committee will conduct informal, public workshops as the forum to have the Staff, agencies, intervenors, and the public respond to the Applicant's analysis. If the Staff, agencies, intervenors or the public believe that the Applicant's assessment or proposed mitigation is insufficient, they may offer substantive additions or modifications to the Applicant's analysis or proposed mitigation or conditions so that consensus may be reached by alternative dispute resolution. Additionally, there may be suggestions to refine the Matrix itself.

For the Committee, the goal is to reach early consensus on matters not subject to contest on a complete description of a potential project impact and a satisfactory condition or alternative to mitigate the associated potential impact, all sufficient for inclusion in the Presiding Member's Proposed Decision.

Alternatively, any party to the proceeding may indicate at a pre-hearing conference concluding the workshops that it cannot reach consensus on a matter and may seek to adjudicate a material dispute of fact in a subsequent evidentiary hearing.

Using information from the workshops and evidentiary hearings, the Committee plans to ultimately use its version of the Siting Review Matrix and the LORS Matrix format in the Presiding Member's Proposed Decision to present the result of its deliberations on the project's environmental impacts and compliance with applicable laws. In addition, the Committee will use the Staff-produced Verification Timetable to present a foreshortened code identifying the timing and nature of verification submittals.

The Committee will not issue the final notices for the workshops and hearings until October 11, 2000. Any party may submit comments on the schedule proposed by this Order to the Hearing Officer, Garret Shean, at (916) 653-6421 or e-mail at: gshean@energy.state.ca.gov prior to October 11, 2000.

Important Notice:

The Committee is attempting to prepare the Proposed Decision in CD-ROM format as well as paper copy. The Committee, therefore, requests that all parties which have submitted or will be submitting materials on which they seek the Committee to rely in the preparation of the Proposed Decision make them available to the Committee in electronic form. Such electronic submittals should be made no later than the first evidentiary hearing.
