The California Energy Commission Committee is reviewing an application by the Mountainview Power Company to construct a 1056-megawatt (MW) natural gas-fired combined cycle power plant. The project would be located at the existing power plant site formerly owned by Southern California Edison (SCE) at the corner of San Bernardino Avenue and Mountain View, now annexed to the City of Redlands.

The purpose of the evidentiary hearings is to establish the factual record upon which this case will be decided through the taking of oral, written, or documentary evidence from the official parties to the proceeding on the topics listed in the side bar.

The public and interested agencies are encouraged to attend and make comments on the topic of air quality. Written comments on the hearing topics can be submitted to the Energy Commission, Docket Unit (00-AFC-2), 1516 - 9th Street, Sacramento, CA 95814. For consideration in the Committee's Proposed Decision, written comments need to be submitted no later than January 23, 2001.

Whether made at the evidentiary hearing or submitted in writing, public comments will be entered into the record of the proceeding and may be used to supplement or explain the evidence in the record. Public comments by themselves, however, are not sufficient to support a finding of fact or a decision on an issue. In order to present evidence that is sufficient to support a finding of fact or decision on an issue, a citizen, group or agency must have become an official party to the proceeding by having filed a Petition to Intervene as of November 7, 2000.

The Commission's Public Adviser is available to provide information or to assist those interested in participating at the evidentiary hearing, but cannot act as the attorney for any party. The Public Adviser will also assist anyone interested in becoming an official party with the preparation of a post-deadline Petition to Intervene. Documents for Evidentiary Hearing:

The South Coast Air Quality Management District's Preliminary Determination of Compliance (PDOC). This document analyzes the project's compliance with applicable air quality laws and sets forth conditions for construction and operation.

In addition, the staff of the Energy Commission has published an independent air quality analysis in the Revised Air Quality Staff Assessment (SA). The Revised Staff Assessment also evaluates potential project air quality impacts and recapitulates the conditions in the PDOC.

Evidentiary Hearing -

Witnesses may appear by declaration instead of in person if the topic is uncontested. If a topic is contested, a witness must appear in person to testify under oath and be subject to cross-examination by other parties. A party sponsoring an expert witness, either by declaration or in person, shall establish the witness' qualifications.

Unless this matter is resolved between the Appliant and Energy Commission staff before January 23, 2001, the topic will be considered contested. No pre-prepared written testimony is required for this evidentiary hearing.

Electronic Submission
of Evidence:

To assist the Committee in the preparation of the Proposed Decision, each party submitting evidence to the record for the purpose of having the Committee rely upon it in making a finding shall submit that evidence in electronic, Word 97-compatable form on or before January 23, 2001.

Becoming a Party:

Anyone with a legitimate interest relevant to the siting of the proposed power plant may file a Petition to Intervene and become a formal party to this proceeding. Party status provides the rights to present independent evidence, receive pertinent documents, and cross-examine witnesses; it also imposes the duty to comply with various orders, procedures, and filing requirements, as well as be subject to cross-examination by other parties.

In this proceeding, the deadline to file a Petition to Intervene was November 7, 2000. The Public Adviser will assist anyone interested in preparing post-deadline Petition to Intervene.
