On June 17, 2004, the California Energy Commission (Energy Commission) received a petition from the Otay Mesa Generating Company, LLC to modify the Otay Mesa Generating Project. The 590-megawatt project was certified on April 18, 2001. Construction of the plant site began June 21, 2004. The facility is located in Otay Mesa in San Diego County, California, east of the City of San Diego.
DESCRIPTION OF PROPOSED CHANGE: 1) Require the Consumer Price Index based escalator be applied to the $1.2 million air quality mitigation payment pursuant to Condition of Certification AQ-75; 2) the escalator shall be applied from October 31, 2003 until payment is made; 3) the payment shall be made no later than 14 months prior to "first fire" of either combustion turbine or October 31, 2006, whichever comes first.
ENERGY COMMISSION REVIEW PROCEDURES
The purpose of the Energy Commission's review process is to assess the impacts of this proposal on environmental quality, public health and safety. The review process includes an evaluation of the consistency of the proposed changes with the Energy Commission's Decision and if the project, as changed, will remain in compliance with applicable laws, ordinances, regulations, and standards (Title 20, Calif. Code of Regulations, section 1769). A public hearing for the purpose of approving or denying the amendment proposal will subsequently be held at a regularly scheduled Energy Commission business meeting.
This Notice of Receipt and Staff Analysis are being mailed to interested parties and property owners adjacent to the project site who may want to participate in the amendment process.

The order (if approved) will also be posted on the webpage.
