Otay Mesa Generating Company, LLC, the owner/operator of the Otay Mesa Generating Project, located in the City of San Diego, San Diego County, has submitted a petition to amend their Energy Commission Decision in order to transfer ownership of the Otay Mesa Generating Project to Otay Mesa Energy Center, LLC. The new owner is an indirect, wholly owned subsidiary of Calpine Corporation. A representative of the new project owner has provided a declaration, under penalty of perjury, that Otay Mesa Energy Center, LLC agrees to comply with the conditions of certification in the Energy Commission's Decision for the Otay Mesa Generating Project. In addition, the name would change from the Otay Mesa Generating Project to the Otay Mesa Energy Center.

STAFF RECOMMENDATION

Staff has reviewed the petition and finds that it complies with the requirements of Title 20 of the California Code of Regulations, Section 1769(b), and recommends approval of the ownership change.

CONCLUSION AND ORDER

The California Energy Commission hereby adopts the staff's recommendation and approves the transfer of ownership from Otay Mesa Generating Company, LLC to Otay Mesa Energy Center, LLC and changing the name from Otay Mesa Generating Project to Otay Mesa Energy Center.
