REVISED SCHEDULING ORDER

Background

Our initial Scheduling Order, dated March 29, 2002, anticipated that the City of Escondido would approve the Final EIR for the Escondido Research and Technology Center (ERTC) Specific Plan Amendment in September 2002. The City notified Staff by letter dated April 17, 2002, that the Specific Plan adoption date was changed to November 2002. Staff submitted a revised scheduling proposal that reflects the City's changed adoption date. (See, Staff's Status Report No. 5, dated August 23, 2002.) Applicant agrees with Staff's scheduling proposal except for the Biological Mitigation and Monitoring Plan submittal date. (See, Applicant's Status Report #5, dated August 26, 2002.)

The March 29, 2002, Scheduling Order stated that delays in the City of Escondido's ERTC Specific Plan Amendment process could affect the AFC schedule. The proposed ERTC Specific Plan Amendment includes land use modifications that are necessary for the proposed project to comply with local laws, ordinances, regulations, and standards (LORS). The parties understand that we will not commence evidentiary hearings until the City adopts the ERTC Specific Plan Amendment. As shown below, we have revised the AFC schedule to reflect the City's prospective adoption date.

Discussion

The following Revised Committee Schedule covers events that must occur before the Prehearing Conference. We will require the Applicant to submit all critical path items prior to publication of the Final Staff Assessment. The remainder of the Schedule will be determined at the Prehearing Conference. Since the City's review of the ERTC Specific Plan Amendment has been extended until November 2002, the parties have ample time to resolve pending issues that are identified in the PSA.
