The Committee conducted an Informational Hearing and Site Visit on March 13, 2000. At the hearing, Pastoria Energy Facility (Applicant) requested additional time to develop a proposed schedule in coordination with Commission staff. On March 31, 2000, Staff filed a "Joint Applicant-CEC Staff Proposed Schedule," which is the basis for this scheduling Order.

The following schedule contains an initial list of events that must occur in order to complete the certification review in a timely manner. The schedule only covers the period through release of the Preliminary Staff Assessment (PSA) as requested by Applicant and Staff. Both Applicant and Staff "desire project schedule flexibility from the PSA to the hearings to finalize existing issues and incorporate the actions and comments of other agencies and interested parties." (Joint Applicant-CEC Staff Proposed Schedule, dated March 31, 2000.) The Committee will determine the post-PSA schedule at the Prehearing Conference (or Status Conference, if necessary.)

Several schedule milestones are contingent upon reviews conducted by federal, state, and local agencies. The Committee recognizes that completion of such reviews may necessitate schedule modifications. Since it would be speculative to identify exact dates for certain submittals, the Committee has established deadlines within 10-day increments: early in the month (days 1-10), middle (days 11-20), and late (days 21-31). The Committee encourages Applicant to provide sufficient review time for the responsible agencies to meet these deadlines.

The Committee may modify the schedule at any time either upon its own motion or that of a party. [Cal. Code of Regs., tit. 20, section 1709(c)]. The schedule requires periodic status reports from the parties to determine whether case development is progressing satisfactorily, and to bring potential schedule delays or other relevant matters to the Committee's attention. If Applicant cannot provide necessary information by the dates set forth in the schedule, the Committee will utilize a performance approach that would result in a day-for-day slip in the balance of the schedule.
