NOTICE OF COMMISSION CONSIDERATION OF A REQUEST BY CALPINE TO
EXTEND THE ONLINE DATE BEYOND THE SEPTEMBER 30, 2001, DEADLINE

PLEASE TAKE NOTICE that the Energy Commission will consider a request by Calpine Corporation to extend the September 30, 2001, deadline for commercial operation of the Calpine King City LM 6000 emergency peaker project. The Energy Commission certified this project on May 2, 2001, pursuant to the Energy Commission's emergency siting regulations and the Governor's Executive Orders D-26-01 and D-28-01, which require emergency generators to be online no later than September 30, 2001.

PUBLIC HEARING

The Energy Commission will conduct a public hearing to consider Calpine's request at the Commission's regularly scheduled business meeting as follows:

Parties, interested agencies, and members of the public who cannot travel to Sacramento for the public hearing, may participate via teleconference by calling 1-888-823-5065, toll free, beginning at 9:45 a.m. The passcode is Business Meeting and the conference leader's name is Jerome Lee. Please identify yourself and your organization when your call is accepted.

REQUIRED SUBMITTALS

Calpine shall file and serve legal argument and supporting documentation in support of its request by 5 p.m., Thursday, August 16, 2001. Calpine's submittal shall include responses to Staff's inquiries on this matter, which were provided to Calpine on July 24, 2001. Staff shall file its analysis of Calpine's submittals by 12 noon, Tuesday, August 21, 2001.

Parties, interested governmental agencies and members of the public should file their written comments no later than 12 noon, Tuesday, August 21, 2001. However, it is not necessary for members of the public to submit written comments in order to make oral presentations at the hearing.

All written materials shall be filed with the Energy Commission Docket Unit and served on the attached list of parties and interested governmental agencies by e-mail in addition to the required printed copies in accordance with Section 1210 of the Commission's regulations. (Title 20 Cal. Code Regs., 1210).
