NOTICE OF FORMAL HEARINGS TO TAKE EVIDENCE The Pittsburg District Energy Facility [Enron Corporation] is proposing a 500 megawatt power plant at USS POSCO in the City of Pittsburg. A Committee of two Energy Commissioners will conduct formal hearings to receive evidence on all aspects of the proposed project, including environmental impacts and technical design. This NOTICE provides the dates and locations of hearings to be held April 28Ð29 and May 3-4, 1999, and if needed, May 5, 1999.

If matters are not concluded on May 4, the Committee will continue the hearings on Wednesday, May 5, beginning at 1:00 at Pittsburg City Hall. The Committee will also conduct formal hearings to take evidence on air quality at a later date in May. The date for the air quality hearing will be announced in a separate Notice.
During formal hearings, the parties (Enron Corporation, Commission Staff, and formal Intervenors who include the City of Antioch, Delta Energy Center, CURE, and CAP-IT) will present evidence consisting of sworn testimony and exhibits on each environmental and technical area that may be affected by the proposed power plant. The purpose of formal hearings is to establish the factual record necessary for the Commission to reach a decision on whether to grant a license to construct and operate the proposed power plant project.
Members of the public and interested governmental agencies are encouraged to attend these hearings and may offer unsworn public comment upon the matters discussed at the hearings. These public comments will be entered into the proceeding record and may be used to supplement or explain the evidence of record. Public comments by themselves, however, are not sufficient to support a finding of fact or a decision on an issue.
