PLEASE TAKE NOTICE that the Committee will conduct a public Conference regarding the schedule for taking evidence on the topics of air quality and water resources as follows:

The purpose of this Conference is to discuss the schedule for taking testimony on the topics of air quality and water resources, which would include evidence of any potential cumulative impacts to air quality and water resources that may result from the proposed PDEF project. The parties shall be prepared to identify any remaining information that is needed to complete their analyses and to provide realistic estimates of the time required to prepare and submit testimony on these topics.

The schedule for filing testimony on air quality has not been finalized pending release of the Final Determination of Compliance (FDOC) by the Bay Area Air Quality Management District (BAAQMD). The Committee anticipates that if the FDOC is available in early May, hearings on air quality could occur in mid-May. However, if the FDOC is delayed, the parties shall discuss whether the Committee may hear testimony on air quality prior to release of the FDOC, and if so, how would the record reflect the conditions imposed by BAAQMD?

The Committee has scheduled formal hearings on April 29, 1999 to take evidence on the topic of water resources. Staff and the City of Antioch have indicated that new information regarding the potential cumulative impacts of wastewater discharge from both the PDEF and the Delta Energy Center projects may require additional time for review and analysis. The City of Antioch is concerned that testimony on this topic may not be complete by April 29. This could hinder the opportunity for Antioch to review and present testimony on water resources according to the Committee schedule. The parties are directed to indicate if any additional information is necessary in order to complete their analyses based on the new data. Further, indicate whether additional time is needed to prepare testimony; and if so, how would this impact the Committee's hearing schedule?
