The Committee for this proceeding will hold a Scheduling Conference to take place as follows:

On April 15, 2002 Russell City Energy Center, LLC (Applicant) filed its Status Report #3 and Request for Conversion to a 12-Month Proceeding. Subsequent to Applicant's filing, Staff informed the Committee that Staff does not agree with Applicant's characterization regarding the status of unresolved issues.


The Committee directs the Staff and Applicant to communicate directly with each other prior to the Status Conference to:

  1. Identify any information items which Staff believes Applicant has failed to provide.

  2. Identify the date on which Applicant will provide to Staff any required, but as yet not submitted, information.

  3. Provide joint recommendations for the appropriate scope of review for any requisite transmission up-grades related to the project.

  4. Propose a joint schedule for the remainder of the case based on the availability of the information noted above.

Staff and Applicant must provide the above-noted information to the Committee in writing no later than close of business on Monday, May 6, 2002. Parties shall of course also serve the Docket Unit (the original and twelve copies) and all those on the proof of service list. The Committee intends to use this information, as well as statements at the Status Conference to establish a schedule for the remainder of the case.

II. Order

Applicant and Staff are ORDERED to comply with the Committee's directives noted above.

In its filing of April 15, 2002, Applicant requests that the Russell City Energy Center proceeding be converted from a proceeding under the provisions of Title 20, Division, 2, Chapter 5, Article 7, to a more traditional 12-month proceeding. That request is hereby GRANTED.
