ORDER GRANTING PETITION TO INTERVENE

Upon consideration of the Petition to Intervene filed by California Unions for Reliable Energy ("Petitioner"), the Committee designated to conduct proceedings in this matter makes the following findings:

  1. On January 11, 2002, a Petition to Intervene in the above-captioned proceeding was filed by:

    California Unions for Reliable Energy (CURE) c/o Marc D. Joseph, Esq. & Mark R. Wolfe, Esq. Adams Broadwell Joseph & Cardozo 651 Gateway Boulevard, Suite 900 South San Francisco, CA 94080

  2. The Petition was timely filed and contains the information required by Section 1207 of the CommissionŐs regulations. (Cal. Code of Regs., tit. 20, § 1207);

  3. The Applicant has filed no opposition to said Petition;

  4. Petitioner's interests are relevant to the above-captioned proceeding; and

  5. Petitioner desires to participate with the rights and obligations of a party as set forth in Section 1712 of the CommissionŐs regulations. (Cal. Code of Regs., tit. 20, § 1712.)

It is therefore ORDERED that the Petition to Intervene in this matter is granted and Petitioner shall be placed on the Proof of Service List as an Intervenor. As an Intervenor, Petitioner may exercise the rights and shall fulfill the obligations of a party as set forth in Section 1712 of the Commission's regulations. (Cal. Code of Regs., tit. 20, ¤ 1712.) Staff shall ensure that Petitioner is immediately provided with a copy of the Application for Certification.
