ORDER GRANTING PETITION FOR REMOVAL

Background

On September 19, 2002, Applicant submitted a petition for removal of the SJVEC AFC from our expedited six-month process. (Cal. Code of Regs., tit. 20, § 2028.) Applicant seeks now to have the AFC processed under our 12-month process. (Pub. Resources Code, § 25540.6.)

Discussion

The Committee finds that under the six-month process, there is substantial evidence in the record that the project may result in a significant adverse unmitigated impact on the environment and the electrical system. (Cal. Code of Regs., tit. 20, § 2028 (c) (1) (2).)

Order

Henceforth, review of the AFC in this matter will proceed following the 12-month process. (Cal. Code of Regs., tit. 20, § 2028 (d).) Staff shall file a Final Staff Assessment in accordance with a Committee revised scheduling order and applicable Energy Commission rules. (See e.g. Cal. Code of Regs., tit. 20, § 1747.)
