NOTICE IS HEREBY GIVEN that the Committee will conduct a Site Visit and public Prehearing Conference as follows:

Wednesday, January 29, 2003
Site Visit beginning at 1:00 pm
Prehearing Conference beginning at 2:00 pm

SITE VISIT

Prior to the Prehearing Conference, members of the public are invited to join the Committee on a tour of the proposed site during daylight hours. Bus transportation to the site will leave from the parking lot of the Assembly Hall at 1:00 pm. Following the site visit, the buses will return to the Assembly Hall and the Prehearing Conference will convene at approximately 2:00 p.m. Persons intending to attend the site visit should make reservations for bus transportation with the Energy Commission's Public Adviser, Roberta Mendonca, by calling 916-654-4489 or, toll free at 800-822-6228 no later than Friday, January 24, 2003.

PREHEARING CONFERENCE

A.    Prehearing Conference and Procedures

The Prehearing Conference is a public forum to assess the parties' readiness for evidentiary hearings. The parties are expected to identify areas of agreement or dispute. Likewise, the parties are expected to discuss those procedures which will facilitate the completion of this licensing process in the most efficient and expeditious manner.

At the Prehearing Conference, all parties shall present their respective opinions concerning those substantive topic areas that remain in dispute. The parties (including Intervenors) shall be prepared to identify:

  • Topic sub-areas that are subject to an agreement and or stipulation;

  • Those sub-areas that remain subject to disagreement and require adjudication;

  • Those witnesses who are required to appear at an evidentiary hearing; and;

  • Other related items, including scheduling, that the parties wish to bring to the Committee's attention.

B.    Prehearing Conference Statements

Each party (including Intervenors) shall serve and file a Prehearing Conference Statement, which shall be identified with "Docket No. 01-AFC-22," and must be received at the Energy Commission's Docket Unit, MS-4, 1516 Ninth Street, Sacramento, California 95814, no later than the close of business on Monday, January 27, 2003.

Each Party's (including Intervenors) Prehearing Conference Statement shall specify:

  1. Topic areas that are subject to written agreement or stipulation without any need for direct or cross-examination.
  2. a) If a witness' presence is desired, the requesting party shall specify the witness required, the subject area of the testimony to be elicited, and whether the witness' direct or cross-examination may occur via conference call.

  3. Any recommendation for the precise order of presentation of topic areas.

  4. Any topic area(s) that a party believes not yet ready to proceed to evidentiary hearings, the reasons therefore; and an estimate as to when the topic will be ready for evidentiary hearings.

  5. Topic areas where a dispute requiring adjudication exists. For each disputed topic, include:

  6. a) a brief summary of the precise nature of the dispute;

    b) The identity and qualifications of each witness a party proposes to sponsor;

    c) Area upon which each witness will testify;

    d) A summary of the testimony each witness is to offer;

    e) An estimate of the time required to present each witness' direct or cross-examination.

  7. Identification (by way of a Proposed Exhibit List) of any exhibits a party (including Intervenors) intends to offer as evidence.


  8. Knowledge of any scheduling conflicts that may tend to extend the certification schedule.

C.    Petitions to Intervene to Become a Formal Party

Anyone with a legitimate interest relevant to the siting of the proposed project may file a Petition to Intervene and become a formal party to this proceeding. Party status reserves the right to:

  • present independent evidence,

  • receive pertinent documents, and

  • cross-examine witnesses.

Becoming an active intervenor or formal party herein also imposes certain duties. Parties are expected, for example, to comply with various orders, procedures, and filing requirements, which the Committee issues. Moreover, parties are subject to evidentiary rules such as cross-examination by other parties. Commission regulations provide that a Petition to Intervene should be filed at least 30 days before the beginning of evidentiary hearings. (20 Cal. Code of Regs., § 1207(b).)

D.    The Public Adviser's Office

The Commission, through its Public Adviser's office, will assist anyone interested in preparing a Petition to Intervene.
