NOTICE OF RECEIPT
On August 30, 2005, the California Energy Commission received a petition from the Sacramento Municipal Utility District (SMUD) requesting approval to transfer the ownership of the Cosumnes Power Plant Project from SMUD to the Sacramento Municipal Utility District Financing Authority, a public agency formed by SMUD and the Modesto Irrigation District under the Joint Powers Act.
The 500-megawatt project was certified on September 9, 2003, construction was initiated on October 31, 2005 and the project is 92 percent complete. The facility is located 25 miles southeast of the City of Sacramento, in Sacramento County.
ENERGY COMMISSION REVIEW PROCEDURES
A statement describing the change in ownership, signed under penalty of perjury by a representative of the proposed new owner of the project, was submitted to the Energy Commission staff for review and approval as required by Title 20, California Code of Regulations, section 1769(b). The statement affirms that the new owner agrees to be bound by the requirements of the Energy Commission's Decision for the Project and understands the obligations imposed by the Conditions of Certification. Based on the information provided, staff intends to recommend the proposed change be approved by the Energy Commission at the October 19, 2005 business meeting.
The petition to change ownership is available on the Energy Commission's website at http://www.energy.ca.gov/sitingcases/smud/index.html.. The order (if approved) will also be posted on the website.
