SMUD's COSUMNES POWER PLANT PROJECT
APPLICATION FOR CERTIFICATION,

Discussion:

At the May 14, 2002, Hearing on Project Status, the Committee was advised by the Commission staff and SMUD (Applicant) of an extensive list of submittals to be performed by the Applicant before it is appropriate to release a Preliminary Staff Assessment for public consideration, and thereafter for a complete Final Staff Assessment. For the purpose of preparing a proceeding Schedule, the Committee notes that many of the critical path information requirements are to be produced by federal or other state agencies upon SMUD's submittal of an application and/or information to such agencies. Some of these applications or submittals were not complete as of the time of the Hearing. Thus, a Schedule must account for SMUD's successful completion of these other agencies' reviews.

The Commission staff and SMUD discussed the information requirements at a subsequent Staff workshop and prepared and jointly submitted a proposed schedule.

Committee Comments:

The Committee has reviewed the information presented at the Hearing on Project Status and the jointly proposed schedule from Staff and SMUD. Based upon SMUD's anticipated submittal of numerous critical path items, the Staff would be able to prepare and publicly release its Preliminary Staff Assessment on or about July 31, 2002. Thereafter, upon the submittal of the remainder of critical path items, particularly the Final Determination of Compliance on Air Quality issues, the Staff would be able to produce its Final Staff Assessment at the end of October 2002.

Both the Preliminary and Final Staff Assessments are vital for meaningful public participation in this proceeding, since they represent not only the consolidated input of other agencies but also the independent review of the Energy Commission's technical staff. Prudence suggests that the Committee not attempt to order a specific schedule for hearings until after the Final Staff Assessment is released, since slippage in the submittal of information for the Preliminary and Final Staff Assessments would adversely affect the remainder of the schedule. However, with a minor modification, the jointly proposed schedule can serve as a guide for activities after the release of the Final Staff Assessment.

Committee Order:

The Committee adopts the attached SMUD Cosumnes AFC Schedule, through the release of the Final Staff Assessment. The Committee directs the Commission Staff to submit monthly status reports, including the

timeliness of the SMUD submittals in accordance with this Schedule. Following the release of the Final Staff Assessment, the Committee will promulgate a schedule for the Committee hearings and the remainder of the proceeding.
